Welcome to Spark My Sport.

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Spark My Sport ("Spark My Sport," "we," "us," or "our") governing your access to and use of the Spark My Sport website, mobile applications, athlete profiles, video streaming services, sports analytics tools, artificial intelligence and machine-learning features, recruiting and scouting tools, and other products and services we make available (collectively, the "Services").

Please read these Terms carefully.

BY CREATING AN ACCOUNT, CLICKING "I ACCEPT," ACCESSING, DOWNLOADING, INSTALLING, OR OTHERWISE USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS AND AGREE TO BE BOUND BY THEM AND BY OUR PRIVACY POLICY.

If you do not agree to these Terms, you may not use the Services.

Certain provisions of these Terms affect your legal rights, including provisions relating to disclaimers, limitations of liability, dispute resolution, arbitration, and class-action rights.

Spark My Sport Services

Spark My Sport provides technology designed to help athletes, coaches, teams, parents and guardians, scouts, recruiters, schools, leagues, tournament organizers, and sports organizations capture, stream, analyze, manage, share, and evaluate sports content and athletic performance.

Depending on the product or feature, our Services may include:

  • Live and recorded sports video
  • Automated or manually created game highlights
  • Athlete profiles
  • Sports statistics and analytics
  • Artificial intelligence and machine-learning analysis
  • Computer-vision analysis
  • Performance measurements
  • Team and roster management
  • Video sharing
  • Recruiting and scouting tools
  • Athlete discovery
  • Coaching tools
  • Event and tournament coverage
  • Video storage and processing
  • Other sports-related technology and services

Features may change over time, and not every feature is available to every user, sport, organization, or geographic location.

Eligibility and Minor Athletes

Because Spark My Sport serves youth and student athletes, special rules apply to minors.

2.1 — Users 18 and Older
If you are at least 18 years old, you may create an account and agree to these Terms on your own behalf, provided you are legally capable of entering into a binding agreement.
2.2 — Users Ages 13–17

Users between 13 and 17 years old may use the Services only with permission from their parent or legal guardian where such permission is required.

By allowing a minor to use Spark My Sport, the parent or legal guardian represents that they:

  • Are authorized to act on behalf of the minor
  • Have reviewed these Terms and our Privacy Policy
  • Consent to the minor's use of the Services
  • Accept these Terms on behalf of the minor where required
  • Accept responsibility for supervising the minor's use of the Services
2.3 — Children Under 13

Children under 13 may not independently create a Spark My Sport account.

Where Spark My Sport provides Services involving children under 13, participation must occur through a parent, legal guardian, school, team, league, club, tournament organizer, or other authorized organization and in accordance with applicable law.

Spark My Sport may require parental or guardian authorization or other appropriate consent before providing particular Services involving children.

2.4 — Organizations
If you accept these Terms on behalf of a school, team, league, club, company, tournament operator, sports organization, or other entity, you represent that you have authority to bind that organization to these Terms.

Accounts and Registration

Certain features require you to create an account.

You agree to provide accurate, current, and complete information and to maintain that information.

You are responsible for:

  • Maintaining the confidentiality of your username and password
  • Preventing unauthorized access to your account
  • Activities conducted through your account
  • Promptly notifying Spark My Sport if you believe your account has been compromised

You may not impersonate another individual, athlete, coach, scout, team, organization, or other entity.

Spark My Sport may require identity, age, organization, or parental/guardian verification when appropriate.

License to Use Spark My Sport

Subject to your compliance with these Terms, Spark My Sport grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for their intended purposes.

Unless expressly authorized by Spark My Sport, you may not:

  • Copy or reproduce the Services
  • Modify or create derivative works of Spark My Sport software
  • Sell, rent, lease, sublicense, or commercially redistribute the Services
  • Reverse engineer or attempt to discover source code
  • Circumvent access controls or security measures
  • Scrape or systematically extract information from the Services
  • Use automated bots or crawlers without authorization
  • Copy or commercially exploit Spark My Sport analytics, databases, or proprietary data
  • Use the Services in a manner inconsistent with these Terms

Ownership and Intellectual Property

Spark My Sport and its licensors own all rights, title, and interest in and to the Services, including our:

  • Software, source code, and object code
  • Artificial intelligence, machine-learning systems, and computer-vision technology
  • Algorithms, analytics systems, databases, and data models
  • User interfaces, designs, graphics, logos, and trademarks
  • Documentation and proprietary workflows
  • Other technology and materials

Except for rights expressly granted under these Terms, no rights to Spark My Sport intellectual property are transferred to you.

Nothing in these Terms grants permission to use Spark My Sport trademarks, logos, branding, or proprietary technology without our written authorization.

User Content

The Services may allow users to upload, submit, record, stream, publish, transmit, or otherwise provide content ("User Content").

User Content may include:

  • Game footage and practice footage
  • Athlete videos, highlights, photographs, and audio
  • Athlete profiles, rosters, statistics, and player information
  • Coaching and scouting information
  • Messages, comments, and other submitted material

You retain ownership of intellectual property rights you hold in your User Content, subject to the licenses granted in these Terms.

License to Spark My Sport for User Content

By uploading, submitting, recording, streaming, transmitting, or otherwise providing User Content through the Services, you grant Spark My Sport a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to:

  • Host, store, process, transmit, stream, display, reproduce, format, encode, and transcode
  • Analyze, create clips and highlights, generate thumbnails, statistics, and analytics
  • Create technical derivative works necessary to provide the Services
  • Distribute content as directed or permitted by the applicable Service
  • Otherwise use User Content as reasonably necessary to operate, provide, maintain, secure, develop, and improve the Services

This license permits Spark My Sport to use automated technologies, including artificial intelligence, machine learning, and computer vision, to process sports content as described in these Terms and our Privacy Policy.

The license does not transfer ownership of your original User Content to Spark My Sport.

Sports Video and Media Rights

If you upload, record, stream, distribute, or otherwise provide sports video or other media through Spark My Sport, you represent and warrant that you have all rights, permissions, releases, licenses, and consents necessary to do so.

This may include permissions relating to athletes, parents or guardians, coaches, teams, schools, leagues, tournament organizers, event operators, venues, broadcasters, photographers, videographers, and other rights holders.

Organizations using Spark My Sport to record or stream events are responsible for determining and obtaining any permissions required by applicable law, league rules, school policies, contracts, venue requirements, or organizational policies.

Spark My Sport's provision of recording, streaming, hosting, or analytics technology does not itself grant a user the right to record or distribute an event.

Artificial Intelligence and Sports Analytics

Spark My Sport may use artificial intelligence, machine learning, computer vision, statistical models, and other automated technologies to analyze sports video and athletic information.

These technologies may generate player tracking, game statistics, performance metrics, video highlights, play identification, movement analysis, athlete comparisons, coaching/scouting insights, recruiting information, predictions, or rankings.

Users should independently evaluate information before making important coaching, recruiting, scholarship, roster, employment, eligibility, medical, or other decisions.

Recruiting and Scouting Disclaimer

Spark My Sport may help athletes showcase their abilities and may help coaches, scouts, recruiters, schools, clubs, teams, and other organizations discover or evaluate athletes.

Athletic evaluations are subjective and may depend on numerous factors outside Spark My Sport's control. Analytics, rankings, statistics, video highlights, or other information provided through the Services should not be interpreted as a guarantee of future performance or recruiting outcomes.

Athlete Profiles

Users may be able to create profiles containing information such as name, photograph, sport, team, school, position, jersey number, graduation year, athletic statistics, performance information, highlights, and recruiting information.

Users are responsible for ensuring that information submitted to an athlete profile is accurate and that they have authority to submit it.

Spark My Sport may remove, correct, restrict, or request verification of information that appears fraudulent, inaccurate, unauthorized, misleading, or otherwise inconsistent with these Terms.

Coaches, Scouts, and Recruiters

Certain Services may permit coaches, scouts, recruiters, or organizations to view athlete information.

Spark My Sport does not independently guarantee the identity, credentials, employment, affiliation, authority, intentions, or legitimacy of every user identifying themselves as a coach, recruiter, scout, or representative of an organization unless we expressly state that such user has been verified.

Athletes and parents or guardians should exercise appropriate judgment when communicating with third parties.

Users must not use Spark My Sport to exploit, harass, intimidate, groom, threaten, or otherwise harm a minor.

Suspected inappropriate conduct involving minors should be reported to Spark My Sport and, where appropriate, relevant authorities.

Acceptable Use and Prohibited Conduct

You agree not to use Spark My Sport to:

  • Violate any law or regulation
  • Infringe intellectual property, privacy, or publicity rights
  • Upload content you do not have permission to use
  • Harass, threaten, bully, demean, stalk, or exploit another person
  • Engage in inappropriate communications with minors
  • Upload obscene, pornographic, hateful, abusive, or unlawful content
  • Impersonate another person or organization
  • Misrepresent your age, identity, credentials, athletic history, or affiliation
  • Access another user's account without permission
  • Collect personal information about other users without authorization
  • Introduce viruses, malware, spyware, or malicious code
  • Circumvent security features or interfere with operation of the Services
  • Scrape, harvest, mine, or systematically download data without authorization
  • Reverse engineer Spark My Sport technology except where applicable law expressly permits it
  • Use Spark My Sport data or content to build a competing service without written authorization
  • Manipulate statistics, analytics, rankings, profiles, or recruiting information
  • Use the Services for fraudulent recruiting or scouting activities
  • Assist another person in performing prohibited activities

Spark My Sport may investigate suspected violations and may restrict, suspend, or terminate accounts where appropriate.

Content Moderation

Spark My Sport is not obligated to review every item of User Content.

We reserve the right, but not the obligation, to review, monitor, restrict, remove, disable, or refuse User Content that we reasonably believe violates these Terms, violates law, infringes rights, presents safety concerns, is inappropriate for youth athletes, is fraudulent, or could harm Spark My Sport or third parties.

Our decision not to remove particular content does not constitute an endorsement of that content.

Third-Party Services

Spark My Sport may integrate with third-party products or services, including camera systems, video platforms, cloud providers, payment processors, social networks, analytics providers, AI services, sports organizations, and technology providers.

Third-party services are governed by their respective terms and privacy policies.

Spark My Sport is not responsible for third-party products or services except to the extent required by applicable law.

Fees and Payments

Certain Spark My Sport Services may require payment.

Pricing, subscription periods, cancellation conditions, and other applicable payment terms will be presented when you purchase the applicable Service.

You agree to provide accurate billing information and authorize applicable charges.

Unless otherwise required by law or expressly stated at the time of purchase, fees paid for Services are non-refundable.

We may modify pricing prospectively by providing notice as required by applicable law.

Communications

By providing contact information, you agree that Spark My Sport may send communications concerning your account and use of the Services, including account notifications, security alerts, event notifications, service announcements, product updates, and operational messages.

Where you provide appropriate consent, we may also send promotional communications. You may unsubscribe from promotional emails using the link provided in those emails.

Consent to receive marketing communications is not a condition of purchasing Spark My Sport Services.

Feedback

If you provide ideas, suggestions, recommendations, feature requests, or other feedback concerning Spark My Sport ("Feedback"), you grant Spark My Sport a perpetual, irrevocable, worldwide, royalty-free right to use that Feedback for any lawful purpose without compensation or attribution.

This provision does not transfer ownership of your User Content.

Copyright and Intellectual Property Complaints

Spark My Sport respects intellectual property rights.

If you believe material available through the Services infringes your copyright or other intellectual property rights, you may submit a written infringement notice to our designated legal contact.

A valid copyright notice should generally identify:

  1. The copyrighted work claimed to have been infringed;
  2. The allegedly infringing material;
  3. Where the material appears within the Services;
  4. Your contact information;
  5. A statement of good-faith belief that the disputed use is unauthorized;
  6. A statement that information in the notice is accurate and authorized; and
  7. Your physical or electronic signature.

Spark My Sport may remove or disable access to allegedly infringing material and may terminate repeat infringers when appropriate.

Privacy

Your privacy is important to Spark My Sport.

Our collection, use, storage, processing, and disclosure of personal information are described in the Spark My Sport Privacy Policy, which is incorporated into these Terms by reference.

Where the Services involve minor athletes, additional parental, guardian, school, team, league, or organizational permissions may apply.

Term and Termination

These Terms become effective when you first access or use the Services or otherwise accept these Terms.

You may stop using Spark My Sport at any time.

Spark My Sport may suspend, restrict, or terminate your access if you violate these Terms, create security/safety risks, expose Spark My Sport to liability, fail to satisfy payment obligations, or as required by law.

Upon termination, your right to use the Services ends. Provisions that by their nature survive termination—including ownership, content licenses, indemnification, disclaimers, limitations of liability, and dispute-resolution—will survive.

Modification or Discontinuation of Services

Spark My Sport continually develops its technology. We may add, modify, restrict, suspend, or discontinue features or portions of the Services.

Where required by law or contractual obligations, we will provide appropriate notice regarding material changes affecting paid Services.

Users are responsible for retaining copies of User Content they wish to preserve.

Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Spark My Sport and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, expenses, and reasonable attorneys' fees arising from or relating to:

  • Your misuse of the Services
  • Your User Content
  • Your violation of these Terms or applicable law
  • Your infringement of intellectual property, privacy, publicity, or other rights
  • Your unauthorized recording or distribution of sports content
  • Your failure to obtain required permissions or releases

Spark My Sport reserves the right to assume control of the defense of any matter subject to indemnification, and you agree to reasonably cooperate.

Disclaimer of Warranties

We do not warrant that:

  • The Services will always be available or uninterrupted
  • Live streams will never be interrupted or videos lost/corrupted
  • Statistics, AI/computer-vision outputs, or player tracking will always be accurate
  • Internet or camera connections will always function
  • Recruiting information will always be accurate
  • Use of Spark My Sport will result in any particular athletic, recruiting, scholarship, educational, financial, or professional outcome

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Limitation of Liability

To the fullest extent permitted by law, Spark My Sport's aggregate liability arising from or relating to the Services or these Terms will not exceed the greater of:

(a) the amount you paid Spark My Sport during the twelve months immediately preceding the event giving rise to the claim; or
(b) US $100.

Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.

Dispute Resolution and Arbitration

Arbitration Administrator
Unless otherwise required by applicable law or agreed by the parties, arbitration will be administered by JAMS pursuant to its applicable consumer arbitration rules and the Federal Arbitration Act.
No Class Actions
YOU AND SPARK MY SPORT AGREE TO BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, COLLECTIVE, OR REPRESENTATIVE ACTION, TO THE EXTENT PERMITTED BY LAW.
Arbitration Opt-Out

You may opt out of this arbitration agreement by sending Spark My Sport written notice within 30 days after first accepting these Terms.

Your notice must contain your full legal name, the email address associated with your account, a clear statement that you are opting out of arbitration, and your signature.

Governing Law

Except to the extent otherwise required by applicable law or governed by the Federal Arbitration Act, these Terms will be governed by the laws of the State of California, USA, without regard to conflict-of-law principles.

Changes to These Terms

Spark My Sport may update these Terms periodically. We will publish revised Terms and update the "Last Updated" date.

For existing users, if we make material changes, we may provide additional notice or request renewed acceptance when required by law.

Continued use of the Services after revised Terms become effective constitutes acceptance where permitted by applicable law.

Electronic Communications

By using Spark My Sport, you consent to receiving electronic communications relating to the Services.

You agree that electronic notices, disclosures, agreements, and communications satisfy legal requirements that such communications be in writing, to the extent permitted by applicable law.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without Spark My Sport's prior written consent.

Spark My Sport may assign or transfer these Terms in connection with a merger, acquisition, financing, corporate restructuring, sale of assets, or similar transaction, subject to applicable law.

Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the greatest extent permitted by law, and the remaining provisions will continue in full force and effect.

No Waiver

Spark My Sport's failure to enforce a provision of these Terms does not waive its right to enforce that provision later.

A waiver of one violation does not constitute a waiver of another violation.

Entire Agreement

These Terms, the Spark My Sport Privacy Policy, and any additional terms applicable to specific Services constitute the entire agreement between you and Spark My Sport concerning your use of the Services, unless you have entered into a separate written agreement with Spark My Sport.

Where a separate written agreement expressly conflicts with these Terms, the separate agreement will control to the extent of the conflict.

California Residents

California residents may have rights under applicable California law.

Under California Civil Code Section 1789.3, California consumers may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs regarding complaints or for additional information concerning the Services.

Nothing in these Terms limits consumer rights that cannot legally be waived.

International Use

Spark My Sport operates from the United States.

Users accessing the Services from outside the United States are responsible for compliance with applicable local laws.

Spark My Sport does not represent that every feature or Service is appropriate or legally available in every jurisdiction.
