The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log on this website and compliant to the Company's terms and conditions. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, prevailing law of Netherlands. Spark My Sport provides an AI-driven platform for sports performance analysis, including but not limited to video recording, stats tracking, and player evaluation. We reserve the right to modify or discontinue any part of our services at any time.
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account details and for all activities that occur under your account. You must provide accurate and complete information when creating an account.
Our services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content.
By uploading content, you grant Spark My Sport a worldwide license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display and distribute such content.
You agree not to engage in any of the following prohibited activities:
The service and its original content, features, and functionality are and will remain the exclusive property of Spark My Sport and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Spark My Sport.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease.
Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
In no event shall Spark My Sport, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
These Terms shall be governed and construed in accordance with the laws of Netherlands, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.
